These Terms of Service (“Terms”) govern your access to and use of ElevateHR’s websites, applications, and related services (collectively, the “Services”), operated by ElevateHR (“we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms.
1. Eligibility and accounts
You must be legally able to enter a binding contract in your jurisdiction. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use.
2. Use of the Services
You agree to use the Services only in compliance with applicable law and these Terms. You will not misuse the Services, attempt unauthorized access, interfere with security or performance, scrape or reverse engineer except as permitted by law, or use the Services to process unlawful or infringing content.
3. Customer data
You retain ownership of data you submit to the Services. You grant us a limited license to host, process, and display that data as needed to provide and improve the Services, subject to our Privacy Notice.
4. Subscriptions and fees
Paid plans are billed according to the pricing shown at checkout or in your order. Fees are exclusive of taxes unless stated otherwise. We may change prices with reasonable notice where required by law.
5. Intellectual property
The Services, including software, branding, and documentation, are protected by intellectual property laws. Except for the rights expressly granted here, we reserve all rights.
6. Disclaimers
The Services are provided “as is” and “as available” to the fullest extent permitted by law. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement where disclaimers are allowed.
7. Limitation of liability
To the maximum extent permitted by law, ElevateHR and its suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill. Our aggregate liability for claims relating to the Services will not exceed the amounts you paid us for the Services in the twelve (12) months before the claim, unless a higher minimum applies under mandatory law.
8. Termination
We may suspend or terminate access for breach of these Terms or as needed to protect the Services. You may stop using the Services at any time. Provisions that by their nature should survive will survive termination.
9. Changes
We may update these Terms from time to time. We will post the revised Terms with an updated “Last updated” date. Continued use after changes constitutes acceptance where permitted by law.
